This sweepstakes (“Sweepstakes”) is sponsored and administered by **JA Paints 307** (“Sponsor”), a business operating in Jacksonville, Duval County, Florida, United States.
This Sweepstakes is subject to all applicable federal, state, and local laws, including but not limited to:
* The Federal Trade Commission Act
* The CAN-SPAM Act of 2003
* The Florida Deceptive and Unfair Trade Practices Act
* Florida promotional sweepstakes regulations, including Section 849.094, Florida Statutes
VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
1. NO PURCHASE NECESSARY
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.
A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
The Sweepstakes is intended to qualify as a lawful promotional sweepstakes under applicable Florida and federal law and is not a lottery.
2. ELIGIBILITY
The Sweepstakes is open only to:
1. Natural persons who are at least eighteen (18) years of age at the time of entry; and
2. Legal residents of the fifty (50) United States or the District of Columbia.
Officers, owners, affiliates, contractors, and immediate family members (spouse, parent, child, sibling, and their respective spouses) and individuals residing in the same household of any such persons are not eligible.
Sponsor reserves the right to verify eligibility and require proof of age and residency prior to awarding a prize.
3. SWEEPSTAKES PERIOD
The Sweepstakes will occur once per calendar month beginning January 1, 2026.
Each monthly entry period begins at 12:00 a.m. Eastern Time on the first calendar day of the month and ends at 11:59 p.m. Eastern Time on the last calendar day of that same month (“Entry Period”).
Sponsor’s designated computer system shall be the official timekeeping device for this Sweepstakes.
4. HOW TO ENTER
Entrants must submit required entry information as specified by Sponsor during the applicable Entry Period. Required information may include:
* Full legal name
* Valid email address
* Telephone number
Limit: One (1) entry per person per Entry Period unless otherwise specified. Duplicate or automated entries may be disqualified.
Entries generated by script, bot, macro, or other automated means are void. Sponsor reserves the right to disqualify any entrant who tampers with the entry process or violates these Official Rules.
5. WINNER SELECTION AND ODDS
One (1) potential winner will be selected in a random drawing conducted by Sponsor from among all eligible entries received during the applicable Entry Period.
The drawing will occur within a commercially reasonable time after the close of the Entry Period.
Odds of winning depend on the total number of eligible entries received during the applicable Entry Period.
The potential winner will be notified using the contact information provided at entry. If a potential winner:
* Cannot be contacted within five (5) calendar days,
* Fails to respond,
* Refuses the prize,
* Is found to be ineligible, or
* Fails to comply with these Official Rules,
the prize may be forfeited and an alternate winner selected.
6. PRIZE
Each month, one (1) winner will receive:
* One (1) digital gift card redeemable exclusively at JA Paints 307’s online store
* Approximate Retail Value (“ARV”): $25.00 USD
Total monthly ARV: $25.00 USD.
The prize:
* Is non-transferable;
* May not be substituted except at Sponsor’s sole discretion;
* Has no cash value except where required by applicable law;
* Shall not expire, in accordance with applicable federal gift card regulations.
Sponsor is not responsible for lost, stolen, misdirected, altered, or unauthorized use of the prize once delivered.
Winners are solely responsible for any federal, state, or local taxes associated with receipt or use of the prize.
7. PUBLICITY RELEASE
Except where prohibited by law, acceptance of a prize constitutes winner’s consent to Sponsor’s use of winner’s name, city, state, likeness, and entry information for promotional, advertising, and publicity purposes in any media now known or hereafter devised, worldwide, in perpetuity, without further compensation.
8. GENERAL CONDITIONS
Sponsor reserves the right, in its sole discretion and to the fullest extent permitted by law, to:
* Cancel, suspend, or modify the Sweepstakes if fraud, technical failures, or other factors impair the integrity of the Sweepstakes;
* Disqualify any individual found to be tampering with the entry process;
* Disqualify any individual acting in violation of these Official Rules or applicable law.
Sponsor’s decisions are final and binding in all matters relating to the Sweepstakes.
9. RELEASE AND LIMITATION OF LIABILITY
By participating, entrants agree to release and hold harmless Sponsor, its owners, affiliates, and representatives from and against any claim, cause of action, liability, loss, damage, cost, or expense arising out of or related to:
* Participation in the Sweepstakes;
* Acceptance, receipt, possession, or use/misuse of the prize;
* Technical failures of any kind;
* Unauthorized human intervention;
* Lost, late, incomplete, or misdirected entries;
* Electronic or human error in the administration of the Sweepstakes.
To the maximum extent permitted by Florida law, Sponsor disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
10. PRIVACY
Information collected from entrants is subject to Sponsor’s privacy practices and will be used for Sweepstakes administration and marketing purposes.
Sponsor represents that it does not sell personal information to third parties. All email communications shall comply with the CAN-SPAM Act of 2003 and applicable regulations.
11. GOVERNING LAW AND VENUE
This Sweepstakes and these Official Rules shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
Any disputes arising out of or relating to this Sweepstakes shall be brought exclusively in:
* The state courts located in Duval County, Florida; or
* The United States District Court for the Middle District of Florida.
Entrants irrevocably consent to the personal jurisdiction and venue of such courts.
12. SEVERABILITY
If any provision of these Official Rules is determined to be invalid or unenforceable under applicable law, such provision shall be severed, and the remaining provisions shall remain in full force and effect.
